Police Chief Joseph Bennett Recommends Termination for Brennan

Tonight, through the Town Manager, the Hopkinton Select Board released the agenda for the upcoming Sergeant Tim Brennan hearing.

The Board intends to conduct a Loudermill Hearing. No witnesses, other than Brennan, will be allowed to speak or present evidence.

The Select Board will conduct a Loudermill Hearing to consider and act on the recommendation of the Police Chief to terminate Police Union member Timothy Brennan,” reads the sole agenda item.

The agenda packet includes a list of accusations the town asserts against Brennan.

  • You knew as of August 21, 2022, of an alleged rape of a minor and failed to report it to law enforcement, which is a violation of Departmental Rules 10.0 Attention to Duty; Internal Affairs Policy 4.01 General Considerations and Guidelines; and Rules and Regulations General Order 2018-0004.
  • You knew as of 2017 of an alleged sexual assault on a minor and failed to report it to law enforcement, which is a violation of Departmental Rules 10.0 Attention to Duty; Internal Affairs Policy 4.01 General Considerations and Guidelines; and Rules and Regulations General Order 2018-0004.
  • You knew in August 2022 that the victim was pursuing a criminal investigation and was concerned for her safety and you failed to report her concern to law enforcement, which is a violation of Departmental Rules 10.0 Attention to Duty and Internal Affairs Policy 4.01 General Considerations and Guidelines.
  • You knew in 2015 that the accused and the victim had engaged in an inappropriate sexual relationship and did not report it to the Chief, which is a violation Regulation 10.1 Professional Image and Rules and Regulations General Order 2018-0004.
  • You used the victim as a babysitter while you were a School Resource Officer and did not obtain prior approval from your supervisor to do so, which is a violation of Rules and Regulations School Resource Officer Policy and Procedure 4.10, Section 9 Prohibited Conduct.

The hearing is open to the public, and will take place at the Hopkinton Senior Center Tuesday, January 16 at 5:00 PM. Brennan, through his Attorney Daniel Fogarty, is expected to present a vigorous defense.

Separately, a petition has been launched by a local resident urging the Select Board to reinstate Brennan. Other residents have written letters to the Select Board in support of Sergeant Brennan.

  1. Neither is the chief. What about his failure to report regarding an alleged predator (Porter) serving as a girls’ soccer coach in another town? Check the timeline as reported by HopNews. Where is the outrage? Both the Chief and the town manager very likely had knowledge of the incident/investigation and ensuing indictment yet remained silent. Both men should resign/be fired and an investigation launched.

  2. Some of what is presented in the Chief’s statement above conflicts with my memory of the timeline previously published in HopNews. It might be helpful to re-summarize that timeline prior to Tuesday’s meeting.

  3. I would not trust this police chief with my worse Enemy. It seems to me that he has terrible judgment. More importantly officer Brennan is a good person that may or may not have violated a policy. This chief seems very quick to recommend his termination. It’s seems very odd. I would not feel very comfortable working in chief Bennetts department. I think the chiefs relationship with porter should be investigated further.
