Former Deputy Chief Porter to be arraigned May 9

Former Deputy Chief of Police John “Jay” Porter will be arraigned at the Middlesex County Courthouse in Woburn on Tuesday, May 9.

Last week a grand jury indicted Porter on three counts of felony rape of a child. The alleged incident took place in connection with an assault of a student when Porter was Hopkinton’s School Resource Officer from 1998 – 2005. According to Middlesex County DA Marian Ryan, the student was 15 years old at the time.

Porter, who requested to retire last Friday, has been on administrative leave pending the outcome of the investigation. Per department policy, during this time he has received full pay and benefits.

While the town hastily accepted his resignation, if convicted Porter may be forced to forfeit his pension. According to the Massachusetts Public Employee Retirement Guide, “A member, after a final conviction of a criminal offense committed…involving violation of the laws applicable to his or her office or position, is not entitled to receive a pension benefit, nor is any beneficiary.”

The investigation was conducted by the Middlesex District Attorney’s office in conjunction with State Police.
