Hopkinton Begins Search for New Fire Chief The Hopkinton Fire Chief Search Committee has been formed and held its first official meeting on Thursday, September 10th. Members are John Mosher, Hopkinton Selectman; Chris LeClaire, Fire Chief of Newburyport, MA; Norman Khumalo, Hopkinton Town Manager; Maria Casey, Hopkinton Human Resources Director and Bob Levenson, Chair Hopkinton Personnel Committee (Chair).
Next steps for the Committee are to finalize the application materials and begin receiving resumes, as well as meet with members of the Fire Department to help inform the process.The Committee hopes to conclude its work in January |

14th Anniversary of September 11,
2001 Attack on America by Robert Falcione September 11, 2015 - Hopkinton resident Christopher Zarba, Jr., who would have turned 48 years-old four days later, was a passenger on Flight 11; but a madman flew his graceful flying machine into the North Tower of the World Trade Center in New York at over 400 miles per hour. Mr. Zarba left behind a four year-old son and a wife on September 11, 2001. Of the 210 victims with Massachusetts ties, Mr. Zarba was the sole Hopkinton victim of the attack on America
His wife, Sheila Zarba-Campbell, who has since remarried, wrote a belated thank you letter on the 10th anniversary to Hopkinton residents through HopNews, extending appreciation for the warm support that people expressed following her loss (click on this paragraph to read it). Above is the memorial at Ground Zero, a relative touching his name, when it was first opened.

Happy Birthday, Hopkinton
September 10, 2015 — In keeping a link to the past, and providing a link to the future, United States Marine Corps veteran Michael Whalen, a Hopkinton native, installed a commemorative stone in the center of the Veterans Memorial Gazebo to celebrate Hopkinton's first 300 years as a town. This was not done on a whim. In 2009 when building the gazebo, Chris Nation of 20th Century Homes, formed a octagonal opening that has since been covered with a piece of plywood for safety. Today, as the stone was cemented in place by Mr. Whalen, the expansion grooves in the cement floor of the gazebo became a part of the display, emanating a radiant design from the center, and from each point on the stone. The stone was cut from granite that came from the original gazebo that had become deteriorated and was replaced with the current one designed by Gorman Richardson Lewis Architects. The original gazebo was built through the fundraising of Ernie Fecteau, and the hard labor of Donald Creswell. Architect Scott Richardson said at the time of the new construction that he chose materials that would last for at least 50 years, a date that Mr. Whalen believes might be a good time for the Hopkinton residents of the year 2065 to open the time capsule he placed below the granite. |

Incident Log Wednesday, September 9, 2015 8:49 pm A 911 caller reported that their children heard someone trying to break into a home on Gibbon Road. Three officers checked the area and advised that the home was secure. 5:16 pm A walk-in spoke with Officer John Moran regarding harassing phone calls. 5:09 pm A 911 caller reported that a tractor trailer unit took down wires on Chestnut Hill in Southborough. The Southborough Police Department was notified. 8:27 am Officer Thomas Griffin spoke with a construction company on Main Street who had equipment on the sidewalk, forcing pedestrians to walk into the roadway. 8:19 am A resident of Lakeshore Drive stated that she was expecting someone from the bank to come by her house and when the individual got there he didn't have an ID and started yelling at her for not letting him inside her home. She also advised that he did not have a front license plate and thought that this was very suspicious. 6:38 am Sgt. Timothy Brennan spoke with a construction company on Wood Street regarding them leaving signs out for 24 hours and advised the foreman to only post them when they are working.
Tuesday, September 8, 2015 6:50 pm Officer John Moran spoke with the operator of a motor vehicle on Hayden Rowe Street and advised them that they were not allowed to park where they were. 4:08 pm Officer Peter Booth spoke with a caller regarding custody concerns. 12:31 pm A caller reported seeing a bus drive on Pleasant Street with the kids jumping on seats, out of control, and the bus driver did not do anything. 11:54 am A caller reported a minor motor vehicle accident on Heartwood Way. Two officers responded and subsequently arrested a 43 year-old male from Bellingham for a Warrant. 10:16 am A motorist reported that the license plate on his business vehicle fell off and could not be found. 9:39 am A caller reported that a box truck swiped the side of a telephone pole on Lumber Street and ripped the whole top of the truck off. Officer Aaron O'Neil responded and notified the DPW to clean the area up. 9:06 am A motorist reported that drivers were not obeying the street lights on West Main Street, causing a bad traffic build ups at intersections. Officer Aaron O'Neil responded to check the area. 6:12 am Two officers responded to assist the Fire Department with a motor vehicle accident with entrapment on Route 495. The patient was transported to the hospital. |

CVS Appeal Continued Board of Appeals Chair Resigns Additional Member recuses himself from CVS Appeal
by Robert Falcione September 9, 2015 — Vice-Chair Michael Peirce stepped into the Chairmanship this evening and opened up the Board of Appeals meeting by announcing that the Chairman, Rory Warren, had resigned. He also announced that an additional Board of Appeals member recused himself from the CVS appeal, bringing the available members down to only four. Mr. Peirce gave the appellant group (anti-CVS) the option of continuing the hearing in front of a five-member board, which he expects to have by the next meeting following expected appointments by the Board of Selectmen. The group chose not to move forward tonight, but to continue to another date. Mr. Warren is expected to come back to be appointed as an associate member, which does not require the heavy lifting that the chairmanship requires. He needs to spend more time with his business, he said. Before the meeting began, one of the members revealed that Michael DiMascio is the member who recused himself from the CVS appeal, because he sports a NO-CVS sign on his property, and he signed the anti-CVS petition. He was not present at this evening's meeting. Mr. Peirce said there is another individual who is expected to be appointed an associate member at next week's selectmen's meeting, so there will be enough members for the hearing continuance on October 7. The matter is under the jurisdiction of the quasi-judicial Board of Appeals, because a group of citizens appealed the building permits issued to Crosspoint Associates for the siting of a CVS Pharmacy at the former Colella's supermarket property. The attorney for Crosspoint agreed to the date for the continuance, but requested that the board consider hearing arguments for the amendment that was submitted by the appellants to add abutters, Hopkinton Drug owner Dennis Katz and Grove Street resident, attorney Jason Mahon, to their list. Mr. Peirce sensing the will of the board, denied the request until the continued hearing. As Mr. Peirce was wrapping up the CVS matter, he was reminded from the visitors' gallery by Selectman Brian Herr that he had not officially opened the public hearing, something he needed to do in order to continue it. Otherwise, a new hearing would need to be posted and abutters would need to be notified again. Mr. Peirce did so. After the meeting, Crosspoint President John Hueber said, "The ZBA gives the appellant the right to continue. We were ready to go." HopNews video recording of most of the meeting is here. |

Live Entertainment Coming to Hopkinton Once Again 110 Grill submits application for liquor and entertainment licenses September 8, 2015 - The extension to 77 West Main Street strip mall, which is being graded and prepared for construction as we speak, will house not only the long-awaited return of the Golden Spoon Restaurant, but the third location for the 110 Grill, the flagship of which is in Chelmsford, Mass. Their second current location is in Nashua, New Hampshire, where happy hours apparently still include discounted alcoholic beverages as well as food specials. Massachusetts banned the practice of serving discounted alcoholic beverages in "Happy Hours" decades ago. The restaurant has submitted an application for an alcoholic beverages license to the selectmen, which includes live entertainment.

Officer Aaron O'Neil checked the area and advised that there was no traffic. 1:43 pm A caller reported that vehicles were parked illegally on Fruit Street. Officer Stephen Buckley responded and issued eleven vehicles parking tickets. 1:28 pm A walk-in turned in a lost wallet. 11:18 am Officer Stephen Buckley issued parking citations to three vehicles on Fruit Street. 8:54 am A 911 caller reported that there was a suspicious package on Hayden Rowe Street. Two officers responded and advised that it was a red cooler belonging to a resident who was training for a marathon. 4:16 am A resident reported that a tree fell down on wires and the power was out for the area of Winter Street and Pond Street. The electrical company was notified and responded. 3:46 am A female 911 caller from Downey Street reported loud kids outside for several hours. Three officers checked the area with a negative find. 12:33 am Officer Linda Higgins advised of a suspicious vehicle that was in a Hayden Rowe Street parking lot then drove away, heading towards Milford, as she approached.
Sunday, September 6, 2015 10:58 pm A resident of Huckleberry Road reported that his vehicle was egged sometime this evening. 10:00 pm Officer William Burchard spoke with several people in boats on Lake Whitehall and advised them of the rules. 2:48 pm A caller reported hearing yelling coming from behind a Wood Street business. Two officers checked the area and advised that all was okay. 2:09 pm Officer Philip Powers issued a parking citation to a motor vehicle on Park Stree. 1:48 pm A caller reported that cars were parked illegally on Fruit Street. Officer Stephen Buckley responded and issued six vehicles parking citations. 9:35 am Officer Stephen Buckley issued parking tickets to eighteen motor vehicles on Fruit Street.

Officer Philip Powers spoke with the individuals who stated that they would not light off anymore fireworks and would stop the music for the night. 8:32 pm A 911 caller from Stagecoach Way reported hearing several gunshots. Two officers checked the area with a negative find on anything suspicious. 5:12 pm Officer John Moran advised that he issued many parking violations on Fruit Street. 10:52 am Officer Linda Higgins retrieved a wallet that was found by a dog walker on Rafferty Road.
Friday, September 4, 2015 10:42 pm A 911 caller reported that her thirteen year-old granddaughter stated that her parents in Arizona were in a fight. The Scottsdale Arizona Police Department was notified and responded. 8:00 pm The State Police Department reported an erratic operator. Officer Peter Booth located the vehicle at a West Main Street gas station and advised that all was okay. 6:37 am A caller reported construction in violation of the town by-law. Officer John Corridan responded and spoke with the company about the by-law.

Weekend On September 12th and 13th the Town of Hopkinton will be celebrating its 300th anniversary. On Saturday there will be a Family Picnic and Fireworks showcase located at the Hopkinton High School, 90 Hayden Rowe St, beginning at 4:00 p.m. Parking for this large event will be at the Hopkinton Schools complex as well as EMC Park. There will be additional parking at the former Colella's Supermarket and shuttle buses provided from the Faith Community Church and EMC located at 52 South St. In order to facilitate the movement of pedestrian, vehicular and Emergency Vehicle movement the following roads will be posted as “No Parking” and strictly enforced:

Incident Log Wednesday, September 2, 2015 6:25 pm Officer Arthur Schofield spoke with a resident of Woodview Way regarding a neighbor above his apartment harassing him. 5:44 pm A resident of Cole Drive reported receiving a IRS scam phone call. 5:27 pm A 911 caller from Hillcrest Drive reported that there family received harassing phone calls which were related to a previous incident. Three officers responded to speak with them. 4:53 pm A 911 caller reported that a motor vehicle was operating erratically on Hayden Rowe Street. Two officers responded and checked the area with a negative find. 4:36 pm Sgt. Scott vanRaalten spoke with a construction company on Wood Street in regards to traffic issues. 4:35 pm Officer Gregg DeBoer spoke with an individual regarding a firearms permit. 3:39 pm A 911 caller reported that a person was walking in the middle of the roadway on Winter Street, paying no attention to traffic. Officer Arthur Schofield located the individual and determined that they live nearby. Their caretaker was notified of the situation and responded to assist. 1:40 pm A passing motorist reported that a member of a construction company was directing traffic on Wood Street and had the roadway down to one lane. Officer Aaron O'Neil spoke with the crew and advised that they would allow the traffic to flow in both directions. 8:54 am Sgt. Joseph Bennett notified the Highway Department that the school sign by Elmwood School was down. |

CVS Permit Appeal
Heats Up Crosspoint Letter to Board of Appeals today cites legal arguments against appeal Crosspoint files NEW permit today - new liquor store still unnamed by Robert Falcione September 4, 2015 — In a Letter of Memorandum to the Board of Appeals through their attorneys, Bowditch and Dewey, Crosspoint Associates, doing business as their Hopkinton entity, Hopkinton CP, LLC, has answered an appeal of their building permits. It disputes the claims made by those appealing the permits granted by the town to Crosspoint for locating a CVS at 61 Main Street, the former Colella's Supermarket. Simply put, the appellants claim that CVS is a Health Services Facility, which is not allowed in the Downtown Business District. Crosspoint (President, John Hueber, file photo, right) argues that CVS is a retail pharmacy, not a health services facility. Incidentally, they have specifically stated from the start that they will not be performing walk-in medical care at the location. Crosspoint's attorney makes note that CVS does that at other locations, and that the appellant's claim is based on information gathered from the internet, and not based on the permit they are appealing. The other major point made in the memo to the Board of Appeals is that the appellants have no standing as aggrieved individuals, because none of them are abutters. Originally, Mukesh "Mike" Patel, owner of Subway and Country Farms at 3 Cedar Street, was a listed party to the appeal, which gave it standing. However, on August 11, 2015, Mr. Patel withdrew his name from the appeal, leaving no one with standing as an abutter. The appellants sought to change that. On August 24, 2015, the appellants requested an amendment to include Dennis Katz, owner of Hopkinton Drug (File photo, left), and Jason Mahon, who is identified on the town's resident's list as an attorney who lives on Grove Street. In their memo, Crosspoint questions Mr. Katz's claim as an abutter, inasmuch as his residence is on Krueger Road. However, a quick check of the Commonwealth of Massachusetts Corporate Database reveals that Mr. Katz is the sole officer of Hopkinton Drug, Inc., solidifying his position as an abutter, and calling into question the authenticity of Crosspoint's claim. If Mr. Katz is determined to be an abutter, as expected, then Crosspoint argues it is too late to add his (and Mr. Mahon's) name, because the appeal period has passed and he must have known about the appeal when it was filed. If Crosspoint prevails on the latter point, the appeal may be thrown out, because there must be an abutter on the list; unless someone shows that they are specially aggrieved as an individual. However, in the amendment to add the two abutters, attorney for the plaintiffs, Eric Goldberg, claims that others may indeed be added to a bona fide appeal, and cites case law to support his position. The appeal will be heard by the Board of Appeals on Wednesday, September 9, 2015, in Room 215 of Town Hall. Crosspoint filed for the permit today to do work within the hashed lines. As of this writing, the permit has not been reviewed by the department. |

about the appeal of the permits issued to Crosspoint/CVS
at the former Colella's Supermarket is about to move
to the front burner again as the Public Hearing for
the appeal is scheduled for next week during the
Board of Appeals meeting, on Wednesday, September 9,
2015 at 7:00 pm.
Some pundits have it that the Appellants have no standing, because there is no longer an abutter listed in appeal.
It is more complicated than

The league plays from June through September and the Red Team (a/k/a Dirty Divas) were the champions with an undefeated record of 11-0 for the season. The captain of the team is Kristy Willadsen. The Green team came in 2nd place and were great opponents. Their captain is Kate Hayward. |

Fired at Millis Cruiser - Vehicle Crashes, Catches Fire
According to a Tweet by the
Massachusetts State Police, two shots were fired at
a Millis Police cruiser, which caught fire afterward.
The police are looking for a white male in a maroon
