Southborough Locals Protest Wrecking Ball
July 19, 2014 — The
Burnett/Garfield House, a Southborough icon since
1847, was purchased on January 25, 2012 for $850,000
by a company whose principal, Jon Delli Priscoli,
also owns the
Grafton Upton Railroad. But now, developer
Robert Moss has gone before the Southborough
Planning Board with a plan to tear the structure
down and reuse some of the parts to build three
English-style cottages, according to
www.mysouthborough.com . Protesters, locals who
would like to see the structure kept whole, have called
Mr. Moss the new owner of the property, but there
has been no recorded transfer of the property to
him. Developers who have a purchase and sale
agreement with a property owner often often assume
the title of owner prior to the actual sale, while
the contingencies work themselves out.

Hopkinton Drug Wins
Preliminary Injunction in Federal District Court "It is David vs. Goliath, and David won" —
Attorney Lawrence G. Green for Hopkinton Drug
July 18, 2014 — Calling it a
"victory for the independent pharmacy," Attorney
Lawrence G Green said the preliminary injunction
ordered today in Federal District Court was
"...comparable to David vs. Goliath and David won."
The injunction orders CVS Caremark, the
division that administers pharmacy benefits for
employers, to reinstate Hopkinton Drug into the
network by Monday. CVS recently dropped Hopkinton
Drug from their network, and the plaintiff alleges
it is part of collusion by CVS and its subsidiary to
conspire to knock Hopkinton Drug out of business.
"The judge said there is a reasonable likelihood of
success that Hopkinton Drug will prevail — CVS has
breeched its covenant of good faith and fair
dealing," stated Attorney Green in a telephone
interview this afternoon.
"This is not a ten-day order. This will be in effect
during further proceedings, which could go on for
months or years.
"We are confident they have no grounds for
reconsideration," he said.

Selectmen Jointly Fill
Planning Board Vacancy
July 15, 2014 — The Board of
Selectmen recessed their scheduled meeting this
evening to hold a joint meeting with the
Planning Board to conduct interviews of three
candidates, and vote to fill a vacancy on the
Planning Board. Candidate Shannon Reilly, a
favorite of Planning Board Chairman Ken
Weismantel, received the first nomination, but
not enough votes from the joint body to pass
muster.
Perennial candidate Frank D'Urso came out on top
with eight votes, and therefore the open seat on
the Planning Board left vacant by the election
to the Board of Selectmen of John Coutinho. He
promised to resign his appointed position on the
Conservation Commission and to resign his
appointed position to the Keefe Tech School
Committee following the completion of the
school's roof project. However, there were other
items prior to the recess and vote.
Frankland Road resident Harold Schmidt opened up
the public forum agenda item by listing a number
of complaints; he first asked about a
grant that he read about in a newspaper that the
town is applying for that would partner the town
with Legacy Farms to help develop the North
spine road on Legacy Farms North.
"I am unaware of any grants that we are applying
for at this point," said Selectman Chair Todd
Cestari.
Later, Mr. Schmidt returned with a clip from the
paper and slid it to Selectman Michelle Gates,
who asked that the board discuss it.
"There is news article that states we have been
in discussions about a grant and we have not,"
Mrs. Gates said.
"There have discussions but there has been no
vote to move forward with a grant," Mr. Cestari
said.
"This is the second time this newspaper has
treated us, and me specifically, poorly," Mrs.
Gates said.
"It is important the townspeople know we haven’t
had a conversation about this," she said.

Sidewalk in the Works
July 15, 2014 — As part of
Legacy Farms' mitigation agreement with the Town of
Hopkinton, the developer in January of 2013 agreed
to an extended completion date of September 15, 2014
for the construction of a sidewalk from East Main
Street at Ray Street to the beginning of the Legacy
Farms property, at the planned entrance to a
proposed hockey rink and marathon center. The
orange/red lines can be seen along the northern side
of the East Main Street shoulder demarking the
location of the sidewalk, going across lawns as well
as through stone walls, which will apparently need
to be relocated.
A section of East Main Street collapsed in
2011 following a visit from Tropical Storm Irene,
but the repair did not take into consideration the
plans for the sidewalk. That area, according to DPW
Director John Westerling, will need a reworking of
the slope to accommodate the width of the new
walkway. Click on the thumbnail to see the 2011
repair.
