Hopkinton 33.8-acre Parcel To Sell for $10 Million, Contingent on Full Approval
250 dwelling units planned for Lumber Street development

October 21, 2013 — REC Hopkinton LLC (Owned by 77 West Main Street owner, Paul Mastroianni) is planning to sell a 33.8 acre parcel of the 204 acres purchased from William and Mary Terry, to Mill Creek LLC for the development of 250 residential units, for over $7 million ($10 million for full build-out approval), once the plans for a 40B development are approved. Mr. Mastroianni paid the Terrys $3 million for the undeveloped land after the Terry's plan to sell to Erickson Retirement Community fell through. Erickson backed out of the $12 million deal shortly before going bankrupt. Mill Creek is calling the new entity Hopkinton Mews (See Free Dictionary for definition).

A 40B development is so-named for the Mass General Law that guides the process. It allows a developer to bypass most local zoning if the host community has less than 10% of the housing stock deemed "affordable" by state housing guidelines. It is a fast-track for the developer, who in this case will deem 25% of the rental units as affordable. According to the application, Hopkinton only has 3.6% of its housing fitting into the "affordable" formula.

The new development will contain a mix of one, two and three bedroom apartments in seven three-story buildings and thirty townhouse units in six two-story buildings. According to the description on the application, the project will also include a  7,500 sq. ft. clubhouse and an in-ground pool, with a fitness center, games area, and leasing offices. Of the 33.8 acre site, 7 acres will be wetlands.

In their planned presentation to the Planning Board Monday evening, the proponents were expected to show their plans to the Planning Board solely for the Planning Board to comment for the purposes of the Comprehensive Permit the group is applying for through the Board of Appeals.

The purchase price for the land is $7.2 million, given the first 180 dwelling units. If all 250 are approved, the price of each additional unit above the 180 is $40,000, adding another $2.8 million to the price tag.

Planning Board Chairman Weismantel called the plan an "unfriendly 40B" because the developer is presenting plans for approval through the state without allowing room for local tastes, zoning or jawboning. Mr. Weismantel said that Legacy Farms was a "friendly 40B" because the developer worked with the town on design elements and mitigation.

After talks with the town over several months, the application explains, the previous process stalled, inspiring the developer to move in this direction.

The permit will require waivers from the Board of Appeals for setbacks, uses, height restrictions and more.
