Hopkinton resident Attorney Kathleen Connolly (Ciriello) Obtains Victory
Before Massachusetts Supreme Judicial Court

Boston, MA (October 31, 2012)… Kathleen Connolly Ciriello, counsel at Murtha Cullina LLP, recently obtained a victory before the highest court in the Commonwealth, the Massachusetts Supreme Judicial Court (SJC), in a decision involving the Massachusetts anti-SLAPP statute.

A landowner, a farmer, sued his tenant, a composting company, because of the company’s failure to remove mulch from the property had prevented the landowner from complying with town wetlands regulations. Citing the Strategic Litigation Against Public Participation statute, G.L.c. 231, §59H 9 (SLAPP statute), the composting company argued that the landowner had infringed upon the company’s constitutionally protected ability to petition the town. The trial court disagreed, finding in favor of the landowner that the company’s response to the town’s notice of a violation was not the type of communication the statute was meant to protect. The SJC, which took the case from the Appeals Court on its own, agreed with the trial court.

Ms. Connolly, who represented the landowner, stated that, “The anti-SLAPP statute was meant to protect against meritless lawsuits that just increase the cost, time, stress and anxiety for parties involved in litigation. The decision helps to narrow and define the parameters of the anti-SLAPP law by clarifying the definition of 'petitioning activity' under the statute.”

Ms. Connolly has a wide range of experience in land use permitting law and litigation, and an extensive background in land use and environmental law with an emphasis on zoning planning and conservation. Ms. Connolly joined Murtha Cullina in 2008. She received her J.D., cum laude, from University of Connecticut Law School, and B.A., magna cum laude, from Boston College. ~ Contributed content.

 

 

 

 

Joseph W. Pratt, 93

 

HOPKINTON – Joseph W. Pratt, 93, died Wednesday, October 31, 2012 after a short illness.  He was the loving husband of Mary (O’Brien) Pratt, to whom he was married for 59 years.  He was a life long resident of Hopkinton.   A graduate of Hopkinton High School, he attended The College of the Holy Cross and served in the U.S. Army during World War II.  He was a local builder, farmer and insurance agent and a longtime member of the Woodville Rod and Gun Club.
 
In addition to his wife, he is survived by his sons Joseph Jr. of Amesbury; Daniel and wife Kelly of Pittsburgh, PA; Thomas and Susan Bush of Hopkinton; Robert and wife Jennifer of Hopkinton; and his daughters Maryanne Bilodeau and husband Thomas of Westborough; and Martha Pratt Rice and husband Joel Rice of Warwick, MA.  He also leaves nine grandchildren, four great-grandchildren and many nieces and nephews.  He is predeceased by six sisters and one brother.

The funeral will be held Tuesday, November 6, 2012 at 9:30 a.m. from the Callanan Cronin Funeral Home, 34 Church Street .  A funeral Mass will be celebrated in St. John the Evangelist Church at 10:30 a.m.  Burial with military honors will follow in St. John’s Cemetery. Calling hours at the funeral home are Monday, November 5, 2012 from 3:00 to 7:00 p.m.

Solar Incentive Program Extended Due to Storm


BOSTON – October 31, 2012 – The Massachusetts Clean Energy Center (MassCEC) and the Department of Energy Resources (DOER) today announced that the deadline for the Solarize Massachusetts program (Solarize Mass) has been extended to Nov. 4 due to the effects of Hurricane Sandy on the Commonwealth.

"With the storm bringing high winds and heavy rain to Massachusetts, we want to ensure that solar installers and home and business owners can safely execute contracts," said MassCEC CEO Alicia Barton McDevitt. "This will give homeowners and businesses extra time to focus on storm recovery while keeping the program open so they can still participate."

Solarize Mass is currently underway in Acton, Arlington, Boston, Hopkinton, Lenox, Lincoln, Melrose, Mendon, Millbury, Montague, Newburyport, Palmer, Pittsfield, Shirley, Sudbury, Sutton and Wayland.

“We want to make sure people will have some extra time to participate in this program following the devastating storm this week,” said DOER Commissioner Mark Sylvia. “We appreciate the work of the communities to get the word out to residents and businesses about the opportunity to lock in discounted solar pricing.”

Suspect Caught - Child is Safe

 

At approximately 2:45 p.m., Virginia State Police stopped the suspect vehicle described below on Route 95 southbound in the town of Waverly in Greensville County. CHERYL KOZACZEK, who was driving, was taken into custody. GAEBRIA KOZACZEK, 3 months old, was in the truck and does not appear to have been harmed.

Virginia Police were on the lookout for the 2004 Toyota Tacoma after Massachusetts State Police at General Headquarters and at the Commonwealth Fusion Center shared information with our counterparts in various states along the eastern seaboard. We had developed information earlier in the day that KOZACZEK was likely in Maryland, and shortly thereafter that she was continuing to head southbound through the Richmond, Va., toward points south. The Virginia fusion center and State Police broadcast descriptions to police agencies in that state. In a similar manner, we shared information with North Carolina State Police, and North Carolina troopers were staging near the border waiting for her. That was not necessary, however, as Virginia troopers located the truck and conducted a motor vehicle stop leading to the arrest and safe recovery of the child. As far as we know, the motor vehicle stop and arrest were without incident. Due to the effective communication and collaboration of both state police agencies, a child was found in a timely manner and unharmed.


Please note that we will not comment on investigative tactics. Likewise, we will not comment further on the information that led us to believe that Gaebria might be endangered. CHERYL KOZACZEK does not have legal custody of the child.

KOZACZEK is being transported to the South Side Regional Jail, where she will be held pending her arraignment as a fugitive from justice. The Hampden County (Mass.) District Attorney’s Office will work with Virginia authorities to arrange KOZACZEK’s rendition to Massachusetts to answer to charges of kidnapping and other offenses. She will likely also be charged with possession of a stolen motor vehicle, as the truck is registered to a family member. The underlying case remains under the jurisdiction of the Westfield Police Department, who did an excellent job with the early stages of the investigation and continued to provide valuable assistance throughout the day.

2:17 pm Officer Philip Powers spoke with a resident of B Street regarding a past breaking and entering.

1:22 pm A resident of B Street reported a past breaking and entering from a motor vehicle. Officer David Shane responded and took a report.

11:58 am A 911 caller reported an open green street junction box on Ash Street. The Fire Department was notified and inspected it.

9:20 am Officer Philip Power assisted the Fire Department with arching wires on Leonard Street.

1:26 am A motorist reported that there was a tree branch in the roadway on Spring Street taking up one lane of travel.

1:03 am Officer Linda Higgins checked two vehicles on Pond Street who were contractors hired by an electrical company to guard the road closure.

10:02 pm Officer Peter Booth stopped a motor vehicle on West Main Street and subsequently arrested a 22 year old female from Upton and charged her with Operating a Motor Vehicle With License Suspended and Operating a Motor Vehicle With License Suspended for OUI.

10:03 pm Officer William Burchard assisted the Fire Department with a report of wires on primary lines on Cedar Street.

9:00 pm The Milford Police Department requested that the Hopkinton Police take their 911 calls until their system can be repaired because it was down.

9:12 pm A resident reported a drain problem on Main Street causing heavy water to enter her basement. The Fire Department and DPW were advised and responded.

8:43 pm Officer Peter Booth checked a motor vehicle that had stalled out on West Main Street.

7:15 pm A 911 call came in from a resident of Pearl Street in Milford. The Milford Fire Department were notified.

6:30 pm Between the hours of 7:10 am and 6:30 pm there were 47 reports of downed trees blocking roadways, downed wires and trees falling onto wires.

2:36 pm A caller reported that her vehicle was hit while it was parked in her works parking lot on South Street. Officer Philip Powers responded and took a report.

10:07 am An alarm company reported that the sewer pump alarm was going off on South Street. The Sewer Department was notified.

8:33 am A 911 caller reported a road rage incident on School Street. Three officers responded but were unable to find the suspect vehicle.

ENDANGERED CHILD ADVISORY ELEVATED TO AMBER ALERT
 

The Massachusetts State Police have just received a request for an AMBER Alert from the Westfield PD regarding a Westfield woman who has taken her 3-month-old daughter, of whom she does not have legal custody. We are in the early stages of assessing the request to determine it if meets the criteria for an AMBER Alert. An AMBER Alert has not issued at this time. In the meantime, we have advised all patrols of the following information, which is also being sent to police departments nationwide.
 
CHERYL E. KOZACZEK, 28, of 80 Woodmont St., Westfield, left her home at approximately 1 a.m. today with her 3-month-old daughter GAEBRIA KOZACZEK in a GRAY 2004 TOYOTA TACOMA pickup truck, MA Plate 85ZH15. Cheryl Kozaczek does not have legal custody of the child. The child’s legal guardian is Cheryl Kozaczek’s mother, of the same address.
 
CHERYL KOZACZEK is Caucasian. She is approximately 5’4” tall, approximately 115 lbs., with long brown hair with blond highlights, often worn in a ponytail. When last seen she was wearing a lightweight tan sportcoat, black jeans, and black Army boots with yellow stiches. She may be carrying a large black diaper bag.
 
GAEBRIA KOZACZEK, a Caucasian female infant, was born on July 18, 2012. She is approximately 2 feet tall and weighs approximately 12 lbs. She has a full head of brown hair and brown eyes. She was last seen wearing pink and black striped tights with either what is a described as a fluffy top or a pink night shirt.
 
The vehicle is a 2004 gray Toyota Tacoma pickup with Mass. Registration 85ZH15. The truck bears a Westfield State University parking decal.
 
CHERYL KOZACKEK’s whereabouts are unknown. She has previously spent time in California. She will sleep in her vehicle or in hotels. Preliminary information indicates that there may be reason to fear for the child’s safety and well-being.

October 30, 2012 — Near the height of the remnants of Hurricane Sandy hitting the region yesterday, the wind was barely strong enough to create white-caps on Hopkinton Reservoir. However, the emergency services responded to dozens of calls for downed trees and poles yesterday and continued to clean up today.

Pirates Boast Beaucoup  Booty

The Hopkinton Pirates, a youth club lacrosse team, raised over $15,800 through their Pirates For A Cure fundraiser.  The Hopkinton lacrosse players decided to shave their heads to raise funds for Dana-Farber Cancer Institute in honor of an extended member of the Pirates family who has been bravely fighting cancer.  Over 30 players waited their turn to sit in the barber’s chair to shed their hair to complete the fundraising activity.   Since the team raised over $10,000 the coaches kept their promise and had their heads shaved.  The Pirates want to thank those who donated to the event including the following local businesses that donated goods and services:  Chris’ Barber Shop in Ashland, Marathon Deli in Ashland, Bill’s Pizza in Hopkinton, The Marathon Restaurant in Hopkinton, Colella’s Supermarket in Hopkinton, and Comlax in Franklin.

9:35 pm A Davis Road resident reported that a suspicious man entered her house, looked around, and then apologized for getting the wrong apartment. Two officers responded and spoke with the man who had the wrong apartment.

9:18 pm A caller reported that there were smashed pumpkins and other small things vandalized on Colella Farm Road. Officer Gregg DeBoer responded and advised that it was minor Halloween acts of vandalism.

8:30 pm There were multiple 911 calls for a motor vehicle accident into a telephone pole on Main Street. Four officers responded and subsequently a 46 year old female from Northbridge was arrested and charged with Marked Lanes Violation and OUI Liquor, 2nd Offense.

6:55 pm A caller from Pond Street complained about a barking dog. Officer Gregg DeBoer responded but did not hear any noise.

6:49 pm A 911 caller from Thayer Heights reported a suspicious motor vehicle. Sgt. John Porter responded and spoke with the operator who was waiting for a person next door to come home.

9:52 pm Three officers told youths to quiet down for the night on Wild Road.

7:52 pm A 911 caller reported an erratic operator on Sanctuary Lane. Officer John Moran responded and advised that the vehicle was parked in a driveway.

5:43 pm There were multiple calls regarding a pig running loose on East Main Street. Two officers responded and were able to place the pig back into its pen.

4:16 pm A caller from Lumber Street reported that a new pool was being filled with water but had no fence around it. Sgt. Scott VanRaalten responded and advised that the pool was currently being built and did not have any water in it.

4:00 pm Sgt. Scott vanRaalten assisted a disabled motor vehicle on Lumber Street.

3:00 pm The Fire Department responded to a 911 call from Main Street for a smoke alarm activation.

2:59 pm A 911 caller reported a motor vehicle accident without personal injury on West Main Street. Sgt. Scott vanRaalten responded and took a report.

1:47 pm A resident of Blackthorne Road reported that an unknown female walked into her house and said that she was there to clean, however the homeowner told her that she was not there to clean. Officer Thomas Griffin located the woman who got separated from her group and assisted her with getting back to her co-workers.

1:41 pm Officer Patrick O'Brien assisted a disabled motor vehicle on West Main Street.

11:56 am A motorist from Wood Street reported that she was just rear ended and the other operator was acting belligerent and thought he might leave. Two officers responded and took a report.

11:21 am A resident of C Street reported that a GPS was stolen out of his vehicle. Officer Thomas Griffin responded and took a report.

10:19 am A caller reported that a silver Jeep was parked in front of her house all morning and most of yesterday. Sgt. John Porter located the operator of the vehicle who was a contractor working at the house across the street.

8:46 am Sgt. John Porter assisted a disabled motor vehicle on Cedar Street.

7:35 am A caller reported that money was taken from his vehicle last night and wished for it to be logged.

6:31 am Officer John Moran moved a dead deer off of the roadway on West Main Street. The Animal Control Officer was notified.

11:24 pm A resident of Wood Street reported that there was a dead deer on the roadway in front of her house. Officer John Moran responded and assisted the Animal Control Officer with removing it.

8:57 pm Officer Peter Booth removed a large branch that was in the roadway on Elizabeth Road.

8:43 pm A caller from Elizabeth Road reported that a vehicle had been parked in front of their house for 10-15 minutes and then left the area. Officer Peter Booth responded and checked the area with a negative find.

6:37 pm Officer Matthew McNeil performed a community policing act on Ash Street.

4:09 pm A 911 caller reported finding a backpack, which had possible drug and alcohol related materials, in a ditch on Edge Hill Road. Officer William Burchard responded and took possession of the backpack.

2:29 pm Two officers responded to a motor vehicle accident without personal injury on Hayden Rowe Street. The telephone company was contacted due to pole damage.

11:11 am A caller reported that a dog was struck by a vehicle on East Main Street. Officer Thomas Griffin and the Animal Control Officer responded.

10:31 am A caller reported that individuals were dumping debris into the woods on the side of Hayward Street. Officer David Shane spoke with the individuals who owned the property and were just dumping brush.

9:58 am Officer Thomas Griffin checked and spoke with the operator of a motor vehicle on Main Street.

8:37 am Detective Timothy Brennan assisted with bus evacuation drills at Center School.

8:33 am Officer Thomas Griffin assisted the Fire Department with an alarm on West Main Street.

7:06 am Officer Thomas Griffin assisted the Fire Department with a fire alarm activation on Wilson Street.

6:02 am A caller reported that someone was starting early at the construction site on Legacy Farms. Officer John Moran responded and issued a verbal warning for violation of the town by-law.

Caution from the Wind

October 29, 2012 — Looks like more than one tree toppled at 8 School Street this afternoon, making the roadway impassable, as the tree is leaning on the primary, or high voltage, wires. Pond Street is impassable between Lamplighter and Winter Street due to a fallen tree, Wilson Street just opened up, a large limb restricted traffic on Cedar Street, tree down at 35 Front, and a tree has just delivered a glancing blow to the side of a house (2:30 pm) as it ripped the wires down at a home on Lorigan Road.

        In New England, there are few open spaces for a small hurricane or large storm to gather strength and hurl projectiles over long distances. The greatest danger with being out and about in one is the chance a tree or limb will fall upon a person or vehicle. And for those who need to go out in this weather, another worry is that a person driving will come upon a situation like the one above, and have it unfold behind them, too, trapping the driver and occupants in the vehicle.

John Healy Duffy Jr

 

HOPKINTON, MA - John Healy Duffy Jr. died peacefully surrounded by his parents and family on Saturday, October 27, 2012 at Bethany Healthcare, Framingham MA.  Born March 6, 1955 to parents Dr. John Healy Duffy Sr. and Mary Jo (Brennan) Duffy, John grew up in Hopkinton, MA as one of 12 children. 

 

He attended St. Tarcisius School and Marian High School in Framingham, and graduated from Nichols College in Dudley MA with a degree in accounting.  After graduating from college, John lived for many years in the New Haven, CT area where he worked as an accountant for several firms, most notably the Legionaries of Christ. 

 

John was a long-time active member of St. Mary’s parish in New Haven.  A devout Catholic, he touched many souls with his vibrant faith and holiness, his humility, his genuine interest in the well-being of every person he met, and his ever-present sense of humor, even in times of great difficulty.  John was often sought out by others for his wise counsel.  He loved to read and play tennis, and often went hiking with friends in the New Haven area. 

 

In addition to his parents,  John is survived by his brothers and sisters, Christine Cloutier and her husband Gaston of Natick, MA, Thomas and his wife Nataline of Randolph, NJ, Michael and his wife Pamela of Hopkinton, MA, Mary Corkery and her husband John of Mansfield, MA, Robert and his wife Sharon of East Greenwich, RI, Peter and his wife Diane of Merrimack, NH, James and his wife Patricia of Shirley, MA,  Richard and his wife Doreen of Cumberland, RI, Letitia Bottino and her husband James of Wareham, MA, and Kathleen Nash and her husband Daniel of Holliston, MA.  John is predeceased by his brother James, who died as an infant. 

 

A funeral Mass will be celebrated Friday, November 2, 2012 at 10 a.m. in St. Mary’s Church, 5 Hillhouse, Ave., New Haven, CT.  Committal will be Saturday, November 3 at 10 a.m. in St. Patrick’s Cemetery, Fall River, MA.  Calling hours at the Callanan Cronin Funeral Home, 34 Church St., Hopkinton, MA are Thursday, November 1, 2012 from 4:00 to 8:00 p.m.

Governor Patrick Declares State of Emergency

FRAMINGHAM, MA – At 12:45 on Saturday, October 27th, Governor Patrick signed a State of Emergency Declaration for the entire Commonwealth of Massachusetts. This will allow the Commonwealth to use all of our resources, and deploy them in a swift and effective manner. The Massachusetts National Guard has been activated. Once the storm reaches us, their mission will be to assist with evacuations, searches and rescues as well as transporting emergency services personnel, augmenting MEMA Rapid Response Teams and assisting law enforcement with security and traffic control.

The Massachusetts Emergency Management Agency (MEMA) is the state agency responsible for coordinating federal, state, local, voluntary and private resources during emergencies and disasters in the Commonwealth of Massachusetts. MEMA provides leadership to: develop plans for effective response to all hazards, disasters or threats; train emergency personnel to protect the public; provide information to the citizenry; and assist individuals, families, businesses and communities to mitigate against, prepare for, and respond to and recover from emergencies, both natural and man made.
