Town Files Suit to Open Ballot
June 7, 2011 — According to Town Clerk Ann Click, a complaint was filed this afternoon in Superior Court to force the opening of an uncounted ballot that was discovered by her during standard archiving of the May 16 election materials.
The election resulted in a tie for one Library Trustee position, and a "failure to elect" opinion from Town Counsel on the two candidates, even though they garnered more votes individually than three other candidates. There was no provision in the process that anticipated a tie.
Selectmen voted on June 1, 2011, with Michelle Gates abstaining, to post the two openings for appointment by their board and the Board of Library Trustees, even though doing so would add an extra position, a condition that was deemed unacceptable in the election process itself.
The action taken today by Town Clerk Ann Click and the Board of Registrars of Voters identifies the uncounted ballot as having been submitted by "John Doe" to protect his anonymity. The sealed envelope it came in has the name of the individual who submitted it, however, the ballot itself will not. Standard procedure is to name those submitting the sealed envelopes and mark those individuals as having voted, giving each voter only one vote. The Clerk's office makes available lists of people who voted, but it is unknown at this time if that list has been made available to anyone requesting it. According to the court document filed today, John Doe was not marked as having voted. If the list has been made available already, then a revised list would have one additional name on it, in essence making John Doe's identity known to anyone comparing both lists; unless the judge orders otherwise.
The document states that John Doe's ballot was not counted and was improperly rejected, and seeks permission from the court to unseal the envelope and count the votes on the ballot contained therein, adding them to the totals in the hope that the result will be a break in the tie vote.

Marion A. Oldach, 91
Marion A. Oldach, 91, died Tuesday, May 31, 2011 at Milford Hospital. She was the widow of William Oldach, who died in January 1993. Born in Framingham, she was the daughter of the late Winthrop and Bertha (Trumble) Avery. She was a 1937 graduate of Framingham High School and a 1941 graduate of Wheelock College, Boston. She was a member of the OFF'ers Club of Framingham and was an accomplished amateur artist. She is survived by her six sons, Robert and his wife Susan of Locust Grove, Virginia, William and his wife Linda of Athol, Gerald and his wife Louise of Bluffton, South Carolina, Stephen and his wife Dianne of Marlborough, Jonathan and Donna French of Westborough, and Richard and his wife Mary of Hopkinton. She also leaves 12 devoted grandchildren. Memorial calling hours will take place on Friday, June 10 from 5:00 to 7:00 p.m. at the First Congregational Church, 146 East Main Street (Route 135), Hopkinton. A memorial funeral service will be held Saturday, June 11 at 10:30 a.m. at the Congregational Church. Burial will be private. Arrangements have been entrusted to the Callanan Cronin Funeral Home, 34 Church Street, Hopkinton. Memorial donations may be made to Ron Burton Training Village, or to The American Cancer Society. |

Hopkinton Marathon Committee Honors Two
June 2, 2011 — Above, Boston Marathon Race Director Dave McGillivray gestures as he sets up Jacques LeDuc to be recognized for his 30 years of painting the Start Line at Thursday evening's Post Marathon Party, coordinated by Hopkinton Marathon Committee Chair Dorothy Ferriter-Wallace. Mr. LeDuc received recognitions from Representative Carolyn Dykema and Senator Karen Spilka and their respective legislative bodies. Mr. LeDuc and Mr. McGillivray have often run into Boston together after the last runners have left Hopkinton. Another person who ran into Boston with Mr. McGillivray at the tail end of a race was 1976 race winner Jack Fultz, who was honored this evening in a similar way for the 35th anniversary of his win. He told stories of that win, and of another run into Boston that gave him a unique distinction among winners. Mr. Fultz saw Mr. McGillivray getting ready to run in, long after everyone else had left, given his duties, and asked if he would like him to run with him. Mr. McGillivray answered in the affirmative, and they both ran into Boston and crossed the finish line. Without even thinking about it, Mr. Fultz, who had come in first in 1976, came in last on that day, making him the only person who has ever come in both in first place and in last place in the Boston Marathon. Annie Marcy was also recognized for her service to the committee, as she has retired from the committee. |

Town Clerk Ann Click sent out this press release today: Town Clerk to Seek Court Authorization to Open and Count Sealed Ballot Vote of newly discovered uncounted absentee ballot could determine winner
June 2, 2011 — At the May 16, 2011, Annual Town Election, voters were asked to fill all five seats on the new Board of Library Trustees. In order to stagger the terms of board members, candidates were to be elected to varying terms of office, with the top two candidates receiving three-year seats, the next two candidates receiving two-year seats, and the fifth candidate receiving a one-year seat.
The results of the election showed a tie vote:
Following the advice of the Elections Division of the Office of the Secretary of the Commonwealth and of Town Counsel, the Town Clerk declared that there were two Failures to Elect, with the results as follows:
In the course of gathering the materials used in the Annual Town Election for preservation, the Town Clerk discovered an unvoted absentee ballot, which was not opened on the day of the election. This ballot currently remains sealed in the envelope in which it was submitted prior to the election. The Town Clerk immediately contacted Town Counsel who, in turn, notified the Elections Division of the unvoted ballot. The Elections Division has determined that the ballot may not be unsealed and counted without a court order.
In light of the possibility that the unvoted ballot may resolve the Failure to Elect and allow the will of the voters to be expressed, the Town Clerk has requested and received authorization from the Town Manager to seek such a court order. Town Counsel has been instructed to prepare and file the necessary papers forthwith. |
