Surrounded by Greens

August 4, 2009 — It looks like a bunny in the grass to some, but this animal is surrounded by edible greens, among them sheep sorrel, a leafy perennial weed with an arrowhead-shaped leaf that is edible. Also called sourgrass, it tastes like rhubarb to the human palate, and is used by some people as an herb or salad.  He was spotted on Falcon Ridge Drive, a sort of Hopkinton outpost off of Spring Street that is very close to the town line with Upton.

State Police Track Violent Fugitive to Departing Plane

Make Arrest Moments Before Take-Off

August 4, 2009 — Massachusetts State Police this afternoon boarded an airliner moments before it was scheduled to take off from Logan Airport and arrested a passenger wanted for assaulting and terrorizing a woman last week in Taunton.

State Police assigned to the department’s fugitive unit and its airport barracks tracked JOSE TORRES-RIVERA, 30, of Taunton to a Jet Blue Airlines flight that was scheduled to depart Logan for Puerto Rico at 2:10 p.m. A State Police Sergeant and two Troopers boarded the flight as it was preparing to roll back from the gate and apprehended TORRES-RIVERA. TORRES-RIVERA was arrested on a warrant charging him with kidnapping, assault and battery with a dangerous weapon, and violating an abuse prevention order.

Evidence suggests that TORRES-RIVERA, armed with a knife, broke into his victim’s Taunton apartment shortly after midnight on July 31. He allegedly hit the woman repeatedly in front of her two children and threatened to stab her. TORRES-RIVERA also took the woman’s cell phone and would not let her or her children leave the apartment. Later in the day, he allowed her to leave when she said she needed diapers for her children. When she left the apartment, she went to a fast food restaurant in Taunton, from where she called police. Taunton Police were unable to locate TORRES-RIVERA and obtained an arrest warrant in Taunton District Court.

The State Police Violent Fugitive Apprehension Section (VFAS) began searching for TORRES-RIVERA, and by this afternoon had tracked his route of flight to the apartment of one of his relatives in Taunton. Although family members were initially uncooperative, Troopers interviewed people who live and work near the apartment and learned that TORRES-RIVERA had left the relative’s apartment carrying a suitcase this morning. Troopers also learned that TORRES-RIVERA had made statements indicating that he was going to Puerto Rico. Further investigation revealed that the suspect was scheduled to fly out of Logan Airport this afternoon.

Fugitive unit Troopers contacted Troop F, the State Police Troop that has jurisdiction over Logan. Troopers assigned to the Logan barracks determined that TORRES-RIVERA was seated on the Boston-to-Puerto Rico flight, boarded the plane immediately, and took him into custody.

The suspect will be held overnight by Taunton Police and is expected to be arraigned tomorrow in Taunton District Court.

The Hopkinton 14U Babe Ruth All Stars defeated Shrewsbury American last Thursday night 5-3 to win the 2009 Boroughs Cup Championship.

The All Stars went an undefeated 10-0 in the Tournament to take the cup for a second straight year. Thursday night’s Championship game victory was powered by the clutch hitting of Tim Moberg and solid pitching from starter Jake Haroian and closer Craig Levergood. Moberg went 3 for 3 with two doubles, a single and 2 RBI. Lead off batter Jason Dlugolecki also went 3 for 3 and Connor Hudson, Sam Rodman and Hank Rudden each had RBI singles. Anthony Hutchins and Jack Lampert also chipped in with solid singles.

Haroian pitched 5 strong innings giving up only 1 run on a wild pitch, scattering 3 hits and 1 walk while striking out 7. Levergood pitched the 6th and 7th innings and put down a tough Shrewsbury team that was staging a late rally by striking out the last 2 batters of the game. Solid defensive plays were made by Sean Dempsey at 1st base and Roddy Towner and Andrew Welzel in the OF. Welzel was also awarded the Boroughs Cup Sportsmanship Award for always playing the game with a great attitude and a smile on his face.

Planning Board Upholds Tree-cutting Fines

Gives Hope to Zio's Bistro

by Robert Falcione

August 4, 2009 — The Planning Board heard the pleas of innocence from the owners of two properties on Ash Street, a scenic road, who had trees cut down, in violation, the Planning Board has determined, of town bylaws, and who received fines issued by the Planning Department and the Tree Warden. They appeared before the Planning Board to see if the board would rescind or reduce their fines for cutting and removing the trees that were, according to the Planning Board, on town property.

One of the residents, Steve Kovacs, of 127 Ash Street said he did not know it was a scenic road and asked if the letter that the Town Planner sent in 2004 informing him of that designation was by regular mail, implying that there is no proof he received it.

Both he and Brian Kelly of 128 Ash Street said that their trees were dead, but in correspondence with the Planning Department, Tree Warden Paul Gleason reported that he travels Ash Street all of the time and that he never noticed four dead trees. Mr. Kovacs said he was fined $900, the maximum of $300 per tree.

The residents argued that the trees were a safety hazard to their children.

Acting Chair Joe Markey said that the residents did not have to expend any money and "if the trees were truly dead, the town would have done it at no charge."

Member Mark Abate motioned to endorse the violation and enforce the fine. The board voted unanimously to do so. See small, short video.

15 Main Street Parking Issues - Speranza says other Business owners are in violation

Jack Speranza, owner of 15 Main Street, a commercial building that has two offices on the second floor,  appeared with Paul Winshman, who, with his wife, Kim, signed a lease for the first floor to build a restaurant called Zio's Bistro. The restaurateurs have two other working restaurants.

Mr. Speranza wants to apply for a shared parking permit with a yet-to-be-determined downtown property owner, because his property does not meet the town's parking requirements for a restaurant.

According to Town Planner Elaine Lazarus, a restaurant is a new use at the location; although others have served food there, that use was never applied for until now.

Mr. Speranza, an attorney, said, "This is not an incident that is isolated to 15 Main."

He mentioned that John Ryerson, the original Gourmet owner, had no parking. Then he spoke of the businesses that have occupied 28 Main Street with little or no parking.

"Bettergoods, then Maria's, and now Denise operates that facility.

"ESL operates where the stove shop was," he said.

"They are all in violation of the [parking] regulations. It is a global issue," he said, awakening a sleeping dog, and recommended that the Zoning Advisory Committee take up the matter.

"Government authority cannot enforce against one property owner without enforcing the other property owners," he said, arguing against arbitrary enforcement.

Mr. Speranza said that he has had conversations with John Burns — who owns the adjacent property at 17 Main Street, and the vacant and overgrown lot next to Action copy — as well as Colella's regarding off-site parking. He said he needs an additional 14 spaces.

"No one is going to park at Colella's to dine there," said one member.

"You haven't tasted my food," said Mr. Winshman.

The reason for Mr. Speranza's visit was to see if the permit and consultant fees could be lowered from the $3200 estimate given to him if he applies for an off-site parking permit, a bylaw so new that one has never been applied for.

The board lowered his fees to $500 plus consultant fees, which they presume could be a quick look at a letter from Mr. Speranza by Town Counsel.

The applicants could also, according to Director of Municipal Inspections, Charles Kadlik, apply to the Zoning Board of Appeals for a waiver of the requirements.

The Winshmans have received a liquor license from Selectmen, and now await the official word from the ABCC, the state governing agency, as well as a shared parking permit hearing and approval.

Wine-Theft Suspect Identified From Video

August 3, 2009 — On Sunday we received a call from Boston PD to inform us they recovered the stolen $20,000 bottle of wine. One Bottle of $20,000 Wine Recovered

August 2, 2009 — In what seems like an impossible event, shortly before 8:00 p.m. this evening, Hopkinton Police Sgt. Joseph Bennett said that another agency had recovered the vintage 1945 $20,000 bottle of Mouton Rothschild that had been stolen from Hopkinton Wine and Spirits on Tuesday, July 29 with its contents intact, but declined to say which agency.

On Tuesday, surveillance footage captured images of two men, and a woman, who was believed to be an accomplice, stealing a total of four bottles of wine totaling $22,000. The story made the Boston television news stations as well as regional newspapers, bringing more attention to the crime than the thieves likely expected.

Sgt. Bennett declined to give out any more information about the case, saying it is still under investigation, but he believes the other agency will release more information tomorrow.

No one was available for comment at Hopkinton Wine & Spirits this evening, because it closes at 6:00 p.m. on Sundays.

Students Raise $1,045 for Stephen Tyrone Johns Fund

Dear Editor,

After the Hopkinton Class of 2013 returned from Washington, DC, we began to collect donations for the Memorial Fund for Stephen Tyrone Johns who was slain at the Holocaust Museum by a right-wing fanatic shortly after we had met him and left the museum in Washington.

We were very saddened by his tragic death and we wanted the Johns Family to know that they are in our thoughts and prayers. Many of us remember the kind smile and friendly manner of Officer Johns. We believe Officer Johns was a very special person and we are grateful for his heroic actions on June 10, 2009.

A check for $1045.00 was sent to the USHMM Officer Johns Family Fund on behalf of the Class of 2013. People from all over Massachusetts, as well as a few other states contributed. We wish to especially acknowledge the Hopkinton Police Association who gave a generous contribution of $200.00. Hopkinton Police Officer Phillip Powers accompanied our class to the United States Holocaust Memorial Museum on June 10, 2009.

We wish to also thank Hopnews .com who helped publicize our efforts. We also thank the Hopkinton Schools, especially Dr. Lynch and Ms. Bugg, who supported our efforts.

New Careers at Cafe Mocha Express

August 2, 2009 — Lisa Pomerleau and partner Sean Hynes, both Milford natives, aim to make their mark in Hopkinton with their new endeavor, the recently purchased Cafe Moca Express located at 77 West Main Street (Dynasty, Dino's plaza).

Lisa left the banking/financial services industry to move back home to be close to family, be with Sean — they have known each other since childhood — and "try something fun." The economy and a motorcycle accident put the brakes on Sean's career as an electrician, and so he decided to join Lisa in her endeavor.

The couple has added healthy " Willow Tree" wraps, including chicken, tuna, and  turkey as well as an acclaimed veggie wrap and macaroni salad to the offerings.

One thing that will stay the same, they promise, is the smooth-tasting New England Coffee; but they have added some new tasty iced coffees like Snickerdoodle, Macaroon,  Brownie Sundae and an Almond Joy iced coffee.  They have also kept their wide selection of yogurt muffins

Their Smoothies, including flavors such as strawberry, wild berry, mango and pineapple coconut, have become an instant hit.

Cafe Moca Express also offers free Wi-Fi internet access as well as a comfortable place to enjoy coffee or lunch.  In the near future there will be a TV in the sitting area with local and world news.

The hours of operation are Mon-Fri from 6:00 am to 6:00 pm, Saturday from 6:00 am to 2:00 pm.

It appears the female in the pink hat was an accomplice by distracting the clerk while the two males stuffed the bottle in their pants. The clerk stated they were not regular customers and has never seen them before. The female asked a number of questions about the liquor behind the counter but did not purchase anything.

The bottles taken totaled $22,000.  They are rare bottles of wine and are collectables because of their age.
